Instructing me

Duty

My duty is to help the court on matters within my expertise, and that duty overrides my obligation to whoever instructs me or pays me. I say so in the report and I mean it in the drafting.

Reports are prepared in accordance with Part 35 of the Civil Procedure Rules and Practice Direction 35, and with the Civil Justice Council's Guidance for the Instruction of Experts in Civil Claims (2014).

How to start

Send the outline of the case and the key dates. I will come back within two working days with three things: whether it is within my expertise, whether I have a conflict of interest, and when I could report. There is no charge for that first look.

What I need

  • Full medical records, paginated, in a single indexed bundle, electronic where possible

  • Imaging — the actual images, not only the reports

  • Letter of instruction setting out the questions you want answered

  • Pleadings, witness statements and any other expert reports served

  • Contact details for the family, if an examination is needed

What to expect

  • Screening opinion — one week from receipt

  • Standard report — two weeks from the appointment, where records are complete

  • Complex report — four weeks

  • Where further investigation is needed — longer, and I will say how much at the outset

  • Part 35 questions and joint statements — within two weeks

  • Conferences and court dates — by arrangement
